Welcome to the Osteria by Capri website (“Site”). These Terms of Service (“Terms”) govern your access to and use of our Site and related services. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use our Site.

  • “Osteria by Capri,” “we,” “us,” “our” refers to the restaurant operations at Hilton West Palm Beach and DoubleTree Suites by Hilton Downers Grove, collectively managed by Cicero Hospitality Group.

  • “User,” “you,” “your” refers to any person who accesses or uses the Site.

  • “Content” means any text, images, graphics, audio, video or interactive features provided on or through the Site.

2. Acceptance of Terms

By using the Site you represent that you are at least 18 years old or accessing with parental or guardian consent. You agree to comply with these Terms and all applicable laws and regulations.

3. Modifications to Terms

We may update these Terms at any time. Changes take effect on the “Effective Date” above. Your continued use of the Site after updates means you accept the revised Terms.

4. Use of the Site

  • You may browse, make reservations or contact us via the Site.

  • You agree not to use the Site for unlawful or unauthorized purposes.

  • You must provide accurate and complete information when making reservations or creating an account.

5. Reservations and Bookings

All reservations are subject to availability and confirmation by Osteria by Capri. We may require a credit card guarantee. Cancellation policies vary by location and event type. Please review our Cancellation Policy when booking.

6. Intellectual Property

  • All Content on the Site is owned or licensed by Osteria by Capri and protected by U.S. and international copyright, trademark and other intellectual property laws.

  • You may view and print Content for personal, non-commercial use only.

  • You may not reproduce, distribute, modify or create derivative works without our prior written consent.

7. User Conduct

You agree not to:

  • Post or transmit any unlawful, abusive or objectionable Content

  • Attempt to gain unauthorized access to our systems or those of other users

  • Interfere with the operation or security of the Site

  • Harvest or collect email addresses or other contact information without consent

8. User-Generated Content

If you submit reviews, comments or other Content (“User Content”):

  • You grant Osteria by Capri a perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish and distribute that Content in any media

  • You represent that you own the rights to your User Content and that its use does not violate any third-party rights

The Site may contain links to third-party websites for your convenience. We do not endorse or control those websites and are not responsible for their content or practices.

10. Disclaimers

  • THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

  • WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

  • WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

11. Limitation of Liability

To the fullest extent permitted by law, Osteria by Capri and its affiliates shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or any services offered through it, even if advised of the possibility of such damages. Our aggregate liability shall not exceed the fees you paid to us in the six months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Osteria by Capri, its officers, directors and employees from any claims, liabilities, damages, losses or expenses (including attorneys’ fees) arising out of your breach of these Terms or your use of the Site.

13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida without regard to conflict of laws principles. Any dispute arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

15. Waiver

Our failure to enforce any right under these Terms does not constitute a waiver of that right.
